History of bail bonds

The roots of the bail process date back to old English law. Sheriffs knew that long periods of time could pass from the arrest to the trial date. Back then, as it is today, keeping someone in jail was costly and problematic. Bail bonds posted by friends and family, who took the responsibility for the defendant's court appearance, became the prison release of choice. In addition, bail prevented the punishment of imprisonment until the accused was found guilty of a crime. This became part of our legal system and is protected by our right to due process.
